These Terms of Service ("Terms") govern your access to and use of the website located at this domain (the "Site") and any purchase you make from North York Auto Body Parts ("we", "us", "our"), located at 177 Limestone Crescent, North York, ON M3J 2R1. By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.
You must be at least 18 years old and able to enter into a binding contract under the laws of Ontario to place an order. By ordering, you represent that the information you provide is accurate and that any payment method you use belongs to you or that you are authorized to use it.
We sell aftermarket replacement auto body and mechanical parts. We make reasonable efforts to describe products accurately, including vehicle year/make/model fitment, but:
All prices are listed in Canadian dollars (CAD) and do not include applicable taxes, shipping, or installation charges unless otherwise stated. Ontario HST and any other applicable taxes are calculated and added at checkout based on your shipping address.
We try to keep prices and stock accurate but errors can occur. If a product is listed at an incorrect price, or is out of stock when an order is placed, we may cancel the order and refund any amount charged, or contact you to confirm the corrected price before proceeding.
Submitting an order is an offer to purchase. Your order is not accepted until we send an order confirmation by email. We reserve the right to limit, refuse, or cancel any order, including for suspected fraud, breach of these Terms, errors in pricing or stock, or requests for unusually large quantities. If we cancel an order after payment, we will refund the amount charged.
Payments are processed through Stripe, Inc. By placing an order, you authorize us (through Stripe) to charge your selected payment method for the order total, including taxes and shipping. We do not store full card numbers on our systems. See our Privacy Policy for details on payment data handling.
Shipping options, costs, and estimated delivery windows are shown at checkout and explained on the Shipping page. Delivery dates are estimates, not guarantees. Risk of loss and title for items pass to you when the carrier delivers the package to the address you provided. You are responsible for inspecting parcels on delivery and reporting visible damage to the carrier and to us within 48 hours.
Returns and refunds are governed by our Return Policy, which forms part of these Terms. Unless stated otherwise on the product page, aftermarket parts are covered by a limited 12-month warranty against manufacturing defects from the date of delivery. This warranty does not cover:
Nothing in these Terms limits any non-waivable rights you have under the Ontario Consumer Protection Act, 2002 or the federal Competition Act.
Body, lighting, cooling, fuel, and emissions parts directly affect vehicle safety and roadworthiness. You agree that all parts purchased from us will be installed by a qualified automotive technician and that you will not install or modify safety-critical components yourself unless you are qualified to do so. We strongly recommend confirming any safety, emissions, or insurance implications of an aftermarket part with a licensed mechanic before installing it.
All content on the Site — including text, layout, logos, photographs (other than supplier-provided product imagery), and code — is owned by or licensed to North York Auto Body Parts and is protected by copyright and trademark laws. You may not copy, reproduce, scrape, republish, or use any part of the Site for commercial purposes without our prior written permission. Vehicle make and model names appearing on the Site are trademarks of their respective owners and are used solely to indicate fitment; we are not affiliated with, sponsored by, or endorsed by any vehicle manufacturer.
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Site, our servers, or the accounts of other users; (c) interfere with or disrupt the Site, including via scraping, automated queries, denial-of-service, or vulnerability scanning without our written permission; (d) submit false, misleading, or fraudulent information; or (e) reverse engineer or attempt to extract the source code of any part of the Site beyond what is permitted by law.
Except for the limited warranty in Section 7 and any non-waivable statutory warranties, the Site and the products sold on it are provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to your use of the Site or any product purchased from us is limited to the amount you paid for the specific product giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use of a vehicle, towing, rental, labour, repainting, or damage to other vehicle systems, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow these limitations; in that case, our liability is limited to the smallest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless North York Auto Body Parts and its directors, officers, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, your installation or use of a product, or your violation of any third-party right or applicable law.
The Site may link to third-party websites or services (for example, payment processors or carriers) that are not controlled by us. We are not responsible for the content, privacy practices, or availability of those sites.
We may modify the Site, our product range, prices, or these Terms at any time. Updated Terms take effect when posted, with the "Effective date" above updated accordingly. If a change materially affects your rights, we will use reasonable efforts to highlight it. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
These Terms and any dispute relating to the Site or a purchase are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Subject to any non-waivable consumer-protection rights you may have, you and we submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, for any dispute arising out of or relating to these Terms or your use of the Site.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms, together with our Privacy Policy, Shipping and Return Policy, are the entire agreement between you and us regarding the Site and your purchases, and supersede any prior agreements on the same subject.
